Will Paul Ceglia get 50% of Facebook?

Will Paul Ceglia get 50% of Facebook?

Predictions

Background

A New Yorker named Paul Ceglia says he paid two installments of $1,000 for 50% of Facebook back in 2003, months before Mark Zuckerberg launched the site in February 2004. Ceglia's shocking allegations have been out there for awhile; now he re-filed a lawsuit with law firm DLA Piper.

Facebook says Ceglia's evidence is fake, and it may well be. Ceglia produced what Ceglia said was a copy of the contract he and Mark Zuckerberg had signed covering two projects on which the two were working together--a Ceglia project called "StreetFax" and a Zuckerberg project called "the face book." He also produced a canceled check for $1,000. He also explained why he waited 7 years to file the claim. Ceglia has produced more than a dozen of what he says are emails between him and Mark Zuckerberg from July 2003 to July 2004, the year in which Facebook was created.

The lawyer representing a man claiming to own a substantial stake in Facebook withdrew from the case on Tuesday, just a day after he defended his client in an interview with The New York Times.

A New York law firm that represented Paul Ceglia in his suit claiming to own part of Facebook Inc. quit the case after determining the contract on which he bases his case is a fraud, according to a letter cited by a judge.

The letter was sent by Kasowitz Benson Torres & Friedman LLP to two other firms that formerly represented Ceglia, DLA Piper LLP and Lippes Mathias Wexler Friedman LLP, according to an order filed yesterday in federal court in Buffalo, NY.

US Magistrate Leslie Foschio fined Ceglia and his current lawyer, Dean Boland, $2,000 for failing to obey earlier orders to produce the document, calling their conduct “beyond disrespect.” The judge disclosed the subject of the letter, which wasn’t made public, in the order, which requires Ceglia to turn it over to Facebook within three days.

Social networking giant Facebook hopes to finally put an end to a bizarre lawsuit filed by an upstate New York former wood-pellet salesman who claims he owns half of the tech phenom. In a motion to dismiss the case Monday, Facebook produced a small labratory’s worth of forensic evidence to bolster its contention that Paul Ceglia’s lawsuit is no more than a “fraudulent shakedown.”

Facebook says its inspection of a computer belonging to a man who claims to have a contract that entitles him to half-ownership of the social-networking giant has turned up an "authentic contract" that does not mention Facebook.

Forensic analysis proves that the alleged 2003 contract between Paul Ceglia and Facebook co-founder and CEO Mark Zuckerberg was an "outright fabrication," Facebook said, asking that Ceglia's suit against Zuckerberg and Facebook be dismissed, according to a Facebook filing yesterday in U.S. District Court for the Western District of New York. The contract, which Facebook contends Ceglia was trying to conceal, was found embedded in electronic data from 2004 and refers only to StreetFax, a Web site Ceglia was trying to develop, Facebook said.
