Attorneys for accused Aurora theater shooter James Holmes say mental health experts have now examined and diagnosed their client, prompting them to ask a judge today to change Holmes' plea to not guilty by reason of insanity.

Lawyers for the man accused of killing 12 people and injuring 70 in a Colorado movie theater say he wants to change his plea to not guilty by reason of insanity.

Attorneys for James Holmes said in a court filing Tuesday they plan to formally ask for the change of plea at a May 13 hearing.

A judge previously entered a standard not guilty plea for Holmes.

Defense lawyers for James E. Holmes, who is charged with killing 12 people and wounding dozens more at an Aurora, Colo., movie theater last summer, signaled in court filings on Wednesday that they were willing to have Mr. Holmes plead guilty if he was spared the death penalty.

This month, the arraignment of alleged gunman James Holmes, accused of first-degree murder, was delayed until March 12 because defense lawyers told Arapahoe County District Court Judge William Sylvester that they need more time to determine an appropriate plea.

Sylvester ruled Jan. 10 that the government established probable cause that Holmes committed the crimes he’s accused of and must face trial. Holmes, who studied neuroscience at the University of Colorado, Denver, is charged with 166 counts, including murder and attempted murder. He may face the death penalty if convicted of first-degree murder.
