It was truly a Good Friday for ex-hand surgeon Michael "She Had a Nice Ass, and I Was Hard" Brown, who was released from Harris County Jail March 28, after serving about 20 days of his 180-day sentence.

Although Harris County Family Court Judge Sheri Dean denied Brown's request for an early release March 25 (based in part of the ex-doc's claim that he contracted e. coli However, Dean said she would not oppose an early release if attorneys for both Brown and his estranged wife reconciled hundreds of thousands of dollars in back attorneys' fees. A court worker confirmed for Hair Balls this morning that Brown was released, but could not provide more information. (A spokesperson for the Harris County Sheriff's Office also stated he had been released "by the order of the court" March 28.)

We weren't able to reach Rachel Brown's attorneys this morning for further explanation, and Michael Brown's lawyer never talks to us, which, like, totally hurts our feelings and stuff.

We're just glad that Brown was able to celebrate Easter with....well, we're not sure who with. Certainly not any of the children from his current or previous marriage. Maybe a young stripper?

A new private poll shows Controller Wendy Greuel and Councilman Eric Garcetti advancing to a runoff in the race for L.A. mayor, with Greuel taking a slight lead ahead of the March 5 primary vote.



The poll was paid for by a Greuel-friendly source who declined to be identified, and conducted by a professional polling firm with extensive experience in L.A. elections.

That could skew the result in Greuel's favor, because Garcetti has a sizable lead with Latino voters. (Garcetti's camp hopes to boost Latino turnout closer to 30%.)

Former President George H.W. Bush is in the intensive care unit of a Houston hospital and is in "guarded condition," family spokesman Jim McGrath said Wednesday.

"The president is alert and conversing with medical staff, and is surrounded by family," McGrath said in a statement.

"Following a series of setbacks including a persistent fever, President Bush was admitted to the intensive care unit at Methodist Hospital on Sunday where he remains in guarded condition," McGrath said. "Doctors at Methodist continue to be cautiously optimistic about the current course of treatment."

The 88-year-old was admitted to the hospital November 23 for bronchitis.

A hospital spokesman said in mid-December that the former president was expected to be home from the hospital in time for Christmas, but that spokesman later said doctors felt that the former president should build up his energy before going home.

Bush has lower body parkinsonism, which causes a loss of balance, and has used wheelchairs for more than a year, McGrath said in an email on Wednesday.

Bush, the 41st U.S. president and a Republican, took office in 1989 and served one term in the White House. The father of former President George W. Bush, he also served as a congressman, ambassador to the United Nations, envoy to China, CIA director and vice president for two terms under Ronald Reagan.

EL PASO, Texas (AP) — Deceased actor Sherman Hemsley's longtime friend can proceed with his burial and running his estate, a Texas judge ruled Friday over the objections of his half-brother from Philadelphia.

Hemsley, who played George Jefferson on the TV sitcom "The Jeffersons," died July 24 of lung cancer. His body has been in refrigerated storage at an El Paso funeral home since.

Judge Patricia B. Chew sided Friday with Flora Enchinton Bernal, who was named in Hemsley's will as the executor of his estate. Chew upheld the validity of his will and granted Enchinton "the authority to dispose, I shouldn't say dispose, to proceed with the remains of Sherman Hemsley in a manner as she wishes."

DNA tests showed Friday that 78-year-old Richard Thornton is Hemsley's half-brother. He wanted to bury his brother at a veterans' cemetery in Philadelphia, where Hemsley grew up.

Thornton's attorney, Mark Davis, said afterward that he would seek an immediate stay of Chew's ruling to prevent the burial from taking place. He said they will eventually appeal.

Court documents indicate Hemsley's estate is worth more than $50,000. Thornton's daughter, Louise Thornton, said her father "didn't come after money."

"He came to bury his brother," she said. "And they turned the whole thing into a three-ring circus."

According to a deposition from Michael Wayne Schmiderer, a DNA expert with testing company Labcorp, the DNA tests show there is a 99.99% probability that Hemsley and Thornton are half-brothers.

During his testimony, Thornton said Hemsley, four years his junior, was born from an extramarital relationship his father had.

"He was a Methodist minister and would have been bad for his career," Thornton said of their father.

Although Thornton said the two didn't call each other or exchange Christmas cards, Hemsley once publicly acknowledged Thornton was his brother. During a 2011 concert in New Jersey, Hemsley "introduced me to the audience and said I was his brother," Thornton said.

Enchinton said she saw Thornton at the concert, but said she didn't remember Hemsley saying that.

During their testimonies Friday, both Thornton and Enchinton agreed they would give Hemsley a military burial, according to his wishes. Hemsley had spent the last 20 years of his life in El Paso.

Earlier in the day, Davis questioned the attorney and notary who did Hemsley's will, suggesting that Hemsley may not have been of sound mind when he signed the document. He also asked Julian Horwitz why he took instructions from Enchinton, a longtime friend of Hemsley's.

"He said he wanted all of his possessions, whatever they were, to pass to Ms. (Enchinton) Bernal," Horwitz said. "At no point did I ever suspect he lacked capacity, based on my 50 years of experience as a lawyer."

Others who testified Friday, including the witnesses to the will being signed, said Hemsley had full use of his faculties when he signed the will.

Heinz-Ulrich Landeck, a nurse at the hospital where Hemsley was being treated, said "he was always an oriented person of the time and place and who he was."

He said Hemsley visited the nursing station once and "talked about his career, he mentioned (Enchinton) was his manager."

Robert Almonte, the U.S. Marshal for the Western District of Texas and a friend of Hemsley's since 1999, also testified. He said Hemsley told him Enchinton was his only family.

"I asked about family in Philadelphia, about wanting to go back," Almonte said, recalling one of their conversations. "He said no. He said Flora was his family."

FORT HOOD, Texas (AP) — An Army appeals court has ruled that the Fort Hood shooting suspect can have his facial hair forcibly shaved off before his murder trial.

The U.S. Army Court of Criminal Appeals' opinion issued Thursday upheld the military trial judge's decision to order Maj. Nidal Hasan to appear in court clean shaven or be forcibly shaved.

It also ruled that Col. Gregory Gross, the judge, properly found that the federal Religious Freedom Restoration Act doesn't give Hasan the right to have a beard while in uniform at trial.

Hasan has said the beard is an expression of his Muslim faith. His attorneys say they'll appeal the ruling.

Hasan faces the death penalty if convicted in the 2009 attack on the Texas Army post that killed 13.

Lopez landed a powerful left hook on Ortiz's jaw late in the ninth that looked to be the punch that did the ultimate damage, although a dazed Ortiz said he thought it happened early in the round.

Lopez (30-4, 18 KOs), his face battered and bruised, and his left eye nearly swollen shut after a vicious all-action fight, leaped onto the ropes flashing an ear-to-ear grin to celebrate one of the biggest upsets in recent years.

Lopez took the fight last month as a replacement for Berto, who failed a doping test that ended any hopes for his rematch with Ortiz. Lopez also had a fight against Kendall Holt fall out when Holt decided against a venue change.

I told everyone I was going to shock the world," a delirously happy Lopez said. "Today's my day. Today's my day.

"I'm excited. I had to fight the fight of my life to win. I knew I caught him every round. I might not have thrown the majority of the punches, but the ones I was throwing, I knew I was connecting."

The loss was a crushing blow for Ortiz (29-4-2). In a controversial move by his promoter, Golden Boy, Ortiz had a potentially huge super welterweight title bout set with undefeated Mexican superstar Canelo Alvarez for Sept. 15 in Las Vegas, and all he had to do was win or draw. He did neither.

Alvarez, who was sitting ringside, shook his head after the stunning finish, not quite sure what he had just witnessed. Alvarez will need to find another opponent, and it likely will not be Lopez, who had moved up from 140 pounds to fight Ortiz at 147. It might be asking too much for the slender fighter to move up two weight classes.

Asked afterward if his jaw was broken, Ortiz said, "Yes, Josesito busted my jaw. But it's OK. I'll be fine. My coaches wanted me to keep going, but I couldn't close my mouth."

Indeed, Ortiz was shown spitting up blood in his corner and lockerroom after the fight.

"I knew he was good, I knew he was good," Ortiz said of Lopez.

Lopez went down in the fifth round after Ortiz hit him behind the head. It was not a knockdown, but Lopez had to be checked out by the ring doctor before continuing.

"It hurt," Lopez said afterward. "Was I quitting? No, I don't quit."

While Ortiz exhibited the superior power and boxing skills throughout, Lopez used a longer reach to counterpunch and connect enough with his right hands and left hooks to keep the fight close.

Asked whether he would give Ortiz a rematch, Lopez said, "They got a rematch clause. Let's do it. As long as I'm ready, I'll fight anybody. I'm the Mexican Paul Williams."

That was a reference to the fighter who was recently paralyzed in a motorcycle accident, who was once considered the most avoided fighter in boxing.

HIGHLAND PARK, Mich.—Rima Fakih, the first Arab-American to be crowned Miss USA, has been sentenced to probation and community service in a Michigan drunken driving case.

The 26-year-old former beauty queen avoided the possibility of jail time during Wednesday’s hearing in Highland Park, an enclave of Detroit. Judge William McConico put her on six months’ probation, ordered 20 hours of community service and said she must pay $600 in fines and costs.

Fakih also must attend an alcohol safety class. She pleaded no contest last month to driving while visibly impaired.

She has said she wasn’t drinking on the night of her arrest in December, but two police breath tests put Fakih’s blood alcohol content at more than twice the legal limit.

An Arizona judge has set a new trial date for Jodi Ann Arias, a California woman accused of brutally killing her ex-boyfriend.

The Huffington Post was the first to report last week that the would-be legal event of 2012, which was scheduled to start late next month, would likely be delayed due to a change in counsel.

Tuesday morning, Judge Sherry Stephens set Oct. 17 as the date jury selection will begin.

Originally slated to begin on Feb. 21, the trial has been delayed because Arias' lawyer, Victoria Washington, asked to withdraw from the case.

During today's case-management hearing, Stephens appointed Jennifer Willmott, a death penalty-qualified defense attorney, to represent Arias. Willmott will have roughly 10 months to get up to speed on the case.

Arias, a 31-year-old photographer from Yreka, Calif., is accused of killing her former lover, Travis Alexander.

A 30-year-old motivational speaker and insurance salesman from Mesa., Ariz., Alexander was found dead on June 9, 2008. BURLINGTON, Vt. (AP) — A Vermont man who prints T-shirts urging people to "eat more kale" has six months to challenge a trademark ruling against him.

The Chick-fil-A restaurant chain says folk artist Bo Muller-Moore's T-shirt infringes on its trademarked "eat mor chikin" slogan.

The Burlington Free Press reports (http://bfpne.ws/GZu5bR) that the Atlanta-based company filed a letter of protest Tuesday with the United States Patent and Trademark Office. The office then issued a preliminary decision saying there's a likelihood that people would confuse the sources of the two phrases, thinking they come from the same place.

Muller-Moore's attorney says there's nothing in the decision that makes him rethink his client's own application for a trademark.

Muller-Moore has been making and selling the "eat more kale" T-shirts and other items for more than a decade.

This is my past and I left it behind. I can use my experiences in life to teach kids. The key point is that they said when you go back to the classroom and a student brings this up to you, you will be able to handle that. I thought that was highly progressive of them.

Unlike California, Florida does have a moral terpitude rule for teachers who can be fired if they're found to be involved in immoral activity.

However, Loftis noted that during his state hearing in Orlando, most of the cases involved teachers accused of felony crimes such as drug use and theft.

"There's no debating whether you were convicted of using drugs or stole something,
but there is debate on whether my past was illegal," he says. "It was not."

Defendant Abercrombie & Fitch and plaintiffs Michael Sorrentino (“Jersey Shore”) and MPS Entertainment LLC were given an upcoming jury trial date by Judge Joan A. Lenard, LALATE can exclusively report. Defendant A&F (NYSE:ANF) is still, however, contesting The Situation’s complaint against it.

Judge Joan A. Lenard has given The Situation a jury trial date of March 25, next year. All non expert discovery between the parties, however, must be resolved by June 29 of this year, the court recently ordered. The Situation is being represented by Wolfe Law Miami attorneys Darren Adam Heitner and Richard Charles Wolfe.

In November, LALATE broke the world exclusive that Sorrentino was suing the retailer regarding its notable Fituation and GTL shirts and similar products. The suit, filed in the Southern District of Florida, claims the defendants engaged in Trademark Infringement, Unfair Competition, False Description arising under the Lanham Act, and Unfair Business Practices arising under Florida state law, LALATE first exclusively reported in November.

Sorrentino is upset about the above t-shirt and another one sold with the caption reading “GTL … You Know the Deal”. The total amount sought by The Situation about the Fituation and the GTL products remains still unknown.

But in his complaint, Sorrentino claimed that a Florida state entitles him to be paid “three times damages”, and that Abercrombie should be “ordered … to pay a reasonable royalty in the amount of $1 million plus exemplary and or punitive damages in the amount of $3 million”.

On February 8, the court order a denial of “defendant’s motion to stay discovery.”. A&F has filed a new motion to dismiss the amended complaint for alleged failure to state a claim. Sorrentino has since replied. The court has yet to rule on the latest motion. The case is MPS Entertainment, LLC et al v. Abercrombie & Fitch Stores, Inc. The defendant is being represented by Gerald J. Houlihan of Miami along with Jessica D. Bradley and John G. Froemming of Jones Day in Washington D.C.

Will toxicology tests on Pastor Zachery Tims find that he had drugs in his system?
The cause of Florida megachurch pastor Zachery Tims death will remain undisclosed to the public -- at least for now.

On Tuesday, the New York County Appellate Court granted Tims' mother's request to prevent city officials from revealing what killed the 42-year-old pastor.

Tims was found dead in the W Hotel in Times Square on August 12, 2011. He founded the New Destiny Christian Center in Apopka, Fla., and led the church as senior pastor for 15 years.

In December, New York County Supreme Court Judge Cynthia S. Kern ruled that there were no laws strictly prohibiting the medical examiner's office from publicly disclosing Tims' cause of death. The office routinely discloses such information in other high-profile cases.

Madeline Tims appealed the judge's decision to the appellate court in January, saying that the cause of death would embarrass the family. The court ruled on Monday she must file an appeal against the Supreme Court's decision by July 9.

Oral arguments in the case are scheduled for Sept. 4 and a ruling is expected sometime in 2013.

Will a jury find James Mee faced discrimination because of his religion after arresting Mel Gibson?
LOS ANGELES (AP) — The deputy who arrested Mel Gibson for drunken driving and claimed he later suffered religious discrimination is settling his case against his department.

Attorneys for James Mee confirmed the settlement was reached Tuesday. The $50,000 settlement must be approved by a county claims board, but a trial scheduled to begin this week has been canceled.

Attorneys Etan Lorant and Yael Trock say they are pleased with the settlement and that Mee never filed the lawsuit for money. Mee, who is Jewish, claimed his superiors discriminated against him after arresting Gibson in 2006.

Phone messages for a county attorney and sheriff's spokesman were not immediately returned.

DAKAR, Senegal (AP) — An Associated Press reporter saw police tussle with international pop star Youssou Ndour, who was pushed back by police when he tried to enter a police station where a leading opposition figure is being detained.

Ndour had come on Saturday to the Criminal Investigation Division as part of a large crowd of opposition supporters who wanted to show their solidarity with Alioune Tine, a well-known human rights activist who is being questioned by police.

Tine was the organizer of a demonstration Friday that turned violent following the decision of Senegal's constitutional court to allow the country's leader to run for a third term. The legal body approved President Abdoulaye Wade's third term bid, even though critics say the constitution allows a maximum of two.

DAKAR, Senegal (AP) — Senegal's opposition called on the population Saturday to rise up against President Abdoulaye Wade's decision to run for a third term, a move that foreshadows more unrest after a night of clashes that saw a policeman stoned to death in the normally peaceful nation on Africa's west coast.

The streets of the capital were strewn with debris, sign of the riots that spread from a downtown square to the interior of the country late Friday after the country's constitutional court approved Wade's candidacy in next month's election.

The constitution was changed soon after the 85-year-old Wade took office in 2000 in order to impose a two-term limit. He argues that because the law was not in effect when he was elected, it should not apply to him.

In a statement Saturday, the M23 coalition representing all the major opposition candidates running in the election said the court had betrayed the people.

"A black page has been written in the history of our country by the decision to validate the candidacy of Abdoulaye Wade," the statement said. "We are inviting the population to organize and mobilize themselves to face Wade. The combat has started."

Opposition candidate Macky Sall, a former prime minister under Wade who is now running to unseat him, said they had given "the order" for people to take to the streets. He denied that future protests could turn violent.

Police spokesman Col. Alioune Ndiaye said a policeman had been killed late Friday during the riots that followed the court's verdict. A graphic video posted on YouTube shows a body lying on the ground, a cinderblock lying near his head, as a group of young men hurl more rocks.

"I can confirm that one policeman was killed," Ndiaye said. "He was attacked and he was hit in the head by a brick. He was stoned to death," he said.

Senegal finds itself at a crossroads before the Feb. 26 election. The dispute over the legality of Wade's candidacy is compounded by the worsening economic situation, including spiraling prices and grinding unemployment.

Wade has alienated many former allies as well as the population by giving an increasing share of power to his unpopular son. Corruption scandals have erupted at regular intervals, detracting from the government's achievements which include the building of numerous roads and bridges.

In 2008, an audit of the Ministry of the Family discovered that officials there had billed the government for coffee spoons costing $74 a piece. The entire cutlery set cost Senegal nearly $30,000.

Will Los Angeles voters pass the law that make adult film actors wear condoms?
Los Angeles city lawmakers voted Tuesday 11-to-1 to require condoms for people who work in the City of Angel’s prolific porn industry.

The preliminary ordinance will be confirmed next week, according to the Associated Press. If confirmed, porn stars must wear proper protection and film companies will have to pay a fee to cover the costs of enforcement and inspections.

The council also plans to gather a group from local law enforcement, workplace agencies and the city attorney’s office to decide on how to implement the new regulation.

The issue came up last month when the AIDS Healthcare Foundation collected more than 70,000 signatures (41,000 were needed to have the measured considered) to propose a citywide vote, or a decision from the city council, on mandatory condom use.

Existing rules required porn stars to test negative for HIV and other STDs within 30 days of filming. Many people argued that such standards were not enough, especially because HIV often does not show up in tests until months after a person contracts the virus.

“There are thousands of STDs in this industry,” Michael Weinstein, president of the AIDS Healthcare Foundation, told Reuters last month. “It’s the ‘ick’ factor. They don’t want to deal with this because it’s sex, and because it’s porn.”

Many people in the adult entertainment industry argued that mandatory condom use would destroy the fantasy associated with pornography.

Nina Hartley, a former porn actress, argued at Tuesday’s meeting that condoms are uncomfortable and the industry already did a good job of regulating the potential spread of disease, according to the Los Angeles Times. And because porn actors are expected to have sex for 30- to 60-minute intervals, they could be susceptible to chafing and open wounds from condoms, which could, in turn, cause more problems in transmitting diseases, she said.

“We are an entertainment medium and it’s not our job to give safe-sex messages to the public,” she said.

But Derrick Burts, a 25-year-old former porn star who contracted HIV and several other STDs within five months of joining the industry, argued for the new regulations.

The fight between Universal Boxing Organizationâ„¢ World Super Middleweight Champion Kali Jacobus and Argentinean challenger Francisco Antonio Mora on December 31 in Espiritu Santo, Luganville, Vanuatu turned out to be a nightmare for everyone involved, and eventually ended up being a non-title bout when Mora decisively failed to make the required weight.

Unfortunately Jacobus was not rewarded for his amazing professionalism. The extra weight gave a motivated Mora too much advantage, and his significant power was a problem for Jocobus from early on. After suffering knockdowns in rounds two, five and six, Jacobus was eventually stopped in round seven after showing a true champion’s heart.

UBO rules state that when a champion loses a non-title bout, the UBO reserves the right to declare the title vacant. Under the circumstances, the UBO choose to consider the fact that Jacobus lost to a boxer two weight classes heavier, and that he showed tremendous spirit and unselfishness in doing so.

Therefore, the title is not declared vacant and Kali Jacobus is still the UBO World Super Middleweight Champion!

I have read most of your character letters that you sent to the judge and looked at the signatures that were obtained for this former sheriff in an attempt to keep him out of prison. Like all police officers, when we are sent to different calls we have to remember one thing. We are POLICE OFFICERS. WE ARE NOT ABOVE THE LAW. POLICE OFFICERS ARE SUPPOSE TO SET THE EXAMPLE, THINK ON YOUR FEET. I know that things can happen at the blink of an eye, but Harrington was down and handcuffed and then Dollar was called. Why did the bail bondsman call Dollar. Why didn't the bail bondsman Watford was at a party with Dollar when Dollar received a call from the bail bondsman that Harrington had been caught. They did not have to go. Maybe the alcohol that they were drinking talked too much for them and told them to go and kick some butt. So they decided to go. Let's not forget the former Phenix City police officer who testified that she saw Watford hit Harrington. Watford said that Harrington had spat blood on him and that's why he slapped him or hit him with a closed fist. Police Officers are suppose to be thick skinned. Harrington should have has an additional charge that's called ASSAULT ON A POLICE OFFICER, that is if Watford was there officially as a Police Officer/Sheriff of just Assault if he was there as a . civilian. Let the courts handle it as they are handling your case. You wouldn't be in that position if you could think on your feetIf I was your normal Joe and hit someone then I would be taken to jail. Will police arrest the person who shot & killed Atlanta rapper Slim Dunkin by January 31,2012?
Disturbing new details have emerged in the case of slain 24-year-old Atlanta rapper Slim Dunkin. Police are now revealing that Dunkin was killed over a stolen piece of candy.

"The information we're getting, it's unconfirmed, but witnesses are saying this whole thing started over a piece of candy," homicide detective David Quinn told Action News on camera.

Dunkin, born Mario Hamilton, grabbed a piece of candy from another man inside an Atlanta recording studio, which led to an argument and fistfight. He was then shot. The rapper was pronounced dead at the hospital.

While there were more than 20 witnesses in the building where Dunkin was shot, police arrived at the hospital and not where the shooting occurred. By the time the police arrived at the studio, witnesses were gone.

The last few rappers our community has lost to violence have all had some sense of retribution attached to the crime. That in no ways justifies it, but when you hear about a rapper dying over a piece of candy, it breaks your heart. A senseless fight turned into a senseless death.

Matt Riddle vs. Luis Ramos has been scratched from the preliminary card of UFC 141. UFC officials announced the change today due to Riddle being hit with an undisclosed illness.

The illness may have to do with Riddle cutting weight for the show. Sources close to the event say that Riddle was vomiting all day, prompting the NSAC to pull him from the event. Riddle tried to talk the commission into allowing him to compete without success.

DETROIT (WXYZ) - A mother of a missing stripper fears her daughter may face the same fate as the women who were recently found murdered in car trunks.

Pamela Johnson says her daughter, Kalisha Madden, was last seen on November 28 leaving the Detroit strip club formerly known as The Sting with three men.

Although Johnson disagreed with her daughter’s choice of a lifestyle and income, she told Action News her daughter was smart and knew how to be safe since she’s been dancing for nearly 10 years.

Johnson says her daughter, who has six children of her own, would never willing leave them. “My daughter is being held against her will, or my daughter is not here anymore,” Johnson told Action News. “ That’s the only two options there is and either way. I’m going to bring her home, I’m going to find my child.”

But Johnson worries it will be the latter option that becomes a reality especially after learning about the recent deaths of four young women. They were all found in trunks of cars during the month of December. Detroit police say three of the four of the victims have escort ads on the website Backpage.com.

“Maybe if a little more attention had been took to my daughter on November 28, these other four girls might not be dead,” said Johnson.

There is $5,000 reward for information that brings Kalisha Madden home.

Terrell Owens reportedly close to accepting offer from Indoor League team
It's been a rough year for one Terrell Eldorado Owens. After catching 72 passes for 983 yards and nine touchdowns for the Cincinnati Bengals in 2010 — his third NFL team in three seasons -- the possible future Hall of Famer was persona non grata in NFL personnel offices. Less the victim of any blackballing and more the recipient of a bill from Father Time, Owens showed in an October workout attended by no NFL teams that six months after knee surgery, he possessed very little of the burst needed to play his position at the highest level.

Owens had received an offer from the Chicago Rush of the Arena Football League soon after that workout, but no acceptance was forthcoming. Perhaps it was the relatively low stake given to players in the IFL -- $225 per game, plus bonuses for winning.

However, another IFL team has upped the ante considerably, and it appears that Owens and agent Drew Rosenhaus might just take the bait. According to the Associated Press, the Allen Wranglers have offered Owens a package more in his ballpark — part ownership in the franchise and up to $500,000 for participation in the 2012 season, which starts in February. Team general manager and former Dallas Cowboys receiver Drew Pearson made the offer, which is apparently within league rules.

"It doesn't make a ton of financial sense, but it would make it the No. 1 fan experience in Collin County," team owner Jon Frankel told the Dallas Morning News. "The awareness of the team would skyrocket, and I would imagine we'd sell out every game."

Collin County, Texas includes a small part of the city of Dallas, which would also keep T.O. on Jerry Jones' radar should be blow the IFL up with his play. Of course, Owens played with Jones' Cowboys from 2006 through 2008.

"At first everybody thought it was a big joke, but it wasn't a big joke. It's serious," Wranglers coach Pat Pimmel told the DMN of the Wranglers' interest in Owens. "It's real close. I think it will be within the next week or so. He would have never got his agent involved in it if he wasn't thinking about it. He can still play, you know that."

So, would the goal be to get back in the NFL? Possibly. There's another possible reason for Owens' potential interest, and it's the obvious one — money. According to the Courthouse News Service, Owens recently sued the law firm of Greenberg Traurig over some bad investment advice.


NFL receiver Terrell Owens claims his Greenberg Traurig attorney encouraged him to invest $2 million in an Alabama entertainment center that included a gaming hall with electronic bingo, which is an illegal gambling operation in Alabama, and a violation of NFL policy. And, he claims, the attorney gave others, with interests adverse to his, control of his $2 million.

Owens is seeking damages for professional negligence and breach of fiduciary duty, plus an accounting of his investment. He'll no doubt find easier (and quicker) money in the IFL.

• UBO Female International Featherweight Champion Agnesse Boza won a non title fight on December 10 at the Night Club Faraon in Riga, Latvia. Boza, originally from Armenia but now based in Riga, dominated Angelina Gulashjak for three rounds before Gulashjak had had enough and retired on her stool before the fourth.


A former WIBF World title-challenger, 29-year-old Boza is now 7-5 (4) and on a three fight winning-streak. Four of her five losses were against opponents who are currently world champions!

Boza captured the UBO title in July with a unanimous decision over Julija Cvetkova at the Jurmala Ice Hall.


• Another result: In case anybody missed it, UBO Inter-Continental Super Middleweight Champion Anthony Dirrell (24-0, 21 KOs) won his fight on December 2 in Santa Ynez, California.

Boxing live on Showtime television, Dirrell scored a fourth round TKO over Canadian Renan St. Juste (23-2-1, 15 KOs).




• UBO International Light Heavyweight Champion Zoltan Kiss Jr. (22-9-3, 6 KOs) was supposed to defend his title on December 17 in Erd, Hungary, but had to pull out about a week before the fight when he suffered a serious hand injury in training.

Kiss was told by his doctor that it could be up to three months before he can fight again, and his first UBO title defense is therefore on hold.


• Kali Jacobus (15-3, 11 KOs), the UBO World Super Middleweight Champion, also had a title defense postponed when his opponent Francisco Antonio Mora (55-17-1, 35 KOs) had travel complications. Jacobus vs. Mora was scheduled for December 15, but will now happen on December 29 instead.

As cited on E! News, the hip hop icon suffered a deep vein thrombosis, in which a blood clot in the leg moves to the lung and blocks a main artery. Shortly before his untimely passing, Heavy D is said to have visited the doctor to complain of a persistent cough; his final performance was at a Michael Jackson tribute show Oct. 8 in Cardiff, Wales.

The beloved performer also suffered from heart disease and thickened artery walls due to high cholesterol.
Heavy D's death was ruled as "natural," the report added, with prescription drugs playing no role. Final autopsy results are expected in about two weeks.

RICHMOND, Va. (AP) - Texas Gov. Rick Perry will not be on Virginia's March 6 Republican presidential primary ballot.

The Republican Party of Virginia said Friday that Perry's campaign had failed to gather the signatures of 10,000 registered voters, the threshold to get on the primary ballot.

The state party said former Massachusetts Gov. Mitt Romney and Texas congressman Ron Paul had gotten the necessary signatures and qualified. Party officials were still verifying the signatures of former House Speaker Newt Gingrich late Friday.

Party spokesman Garren Shipley says the party is validating petitions submitted to the State Board of Elections by Thursday's 5 p.m. deadline. The validation process began Friday morning.

The required 10,000 registered voters must also include 400 signatures from each of Virginia's 11 congressional districts.

CHESAPEAKE, Va. (WAVY) - Chesapeake police have arrested four juveniles in the attack of a former NFL linebacker.

Ed Beard, who was a linebacker for the San Francisco 49ers, told WAVY.com he suffered a concussion when he was attacked at the intersection of Freeman Avenue and Varsity Drive on October 23.

Beard, 71, was attempting to break up a fight on an elementary school baseball field when he was attacked.

Back in October, Chesapeake police spokeswoman Kelly O'Sullivan said about 15-20 young men surrounded Beard.

Beard said he was knocked unconscious. He also suffered a black eye and cuts and bruises.

The former 49er starred at Oscar F. Smith High School and played linebacker and on special teams for San Francisco from 1965 to 1972. The football stadium at his high school now bears his name.

Each of the four youths in police custody are charged with malicious wounding and malicious assault by mob. They are being held at the Chesapeake Juvenile Services Center.

Leon Margules, President of Warriors Boxing and co-promoter of super middleweight contender Donovan "Da Bomb" George (22-1-1, 19 KO's), says pulling George out of his fight against Librado Andrade was the hardest decision he's had to make during his career as a promoter... but it was definitely the right one.

George was scheduled to face the tough veteran Andrade (30-4, 23 KO's) in a 12-round IBF super middleweight title elimination fight Saturday night at the Froilan Lopez Baseball Field in Cozumel, Mexico, but a huge discrepancy in the size of the ring forced Margules to make a very tough call.

"The contract said (event promoter) Golden Boy will use their best efforts to get a 20'x20' ring. The ring was exactly 15' inside. I've never even heard of a ring that small. So, we talked about it as a team and decided to pull the fight. The IBF stood behind us. Donovan's father and fiancée thanked me for standing up for them. Raul Jaimes and Robert Diaz from Golden Boy were very understanding. Even Andrade's trainer said he would have done the same thing."

Margules says George would have fought anyway because it's his nature, but part of his function as promoter is to care about his fighters' well-being. "This was the kind of thing any father would do for their kid. When I've got a fighter who is supposed to fight in the middle of the ring and there is no middle of the ring because it's smaller than any ring I've ever even seen - it's not right to push him out there against a world-class guy who thrives on phone-booth warfare. That's not doing my best to protect my fighter and give him an even chance at winning every fight."

"I do not believe Golden Boy Promotions would do something like this intentionally, but relied on others to handle obtaining an adequate ring for a world-title elimination fight", says Margules. "The fact is, Golden Boy are very competent promoters. They told me a local promoter made the mistake. I give them the benefit of the doubt. As a company with tremendous integrity, all they need to do now is figure out how to make it right for both fighters."

While a decision like this is not made easily or often, Margules says the congratulations and recognition he has received from other boxing insiders has been reassuring. "I haven't heard one competent boxing guy tell me I did anything but the right thing. When my fighter gets to the venue on fight night and says 'How am I going to fight in that ring, I thought you told me the ring would be 20 feet?' he's already mentally handicapped. He would have fought if we asked him to, but there was no way I was going to let him. This is the biggest fight of his life and he's worked very, very hard to get here. There's no way I'm going to let him risk it all in a fight when the other guy has an unfair advantage based on styles. That is why I insisted on a 20 by 20 foot ring in the contract. I would protect my fighter the same way if it ever happened again."

The cop who touched off the 50-shot barrage that killed unarmed groom-to-be Sean Bell was found guilty of violating department guidelines by panicking and blowing his cover when he opened fire on a Queens street, officials said yesterday.

Five years and four days after Bell, 23, was gunned down behind the wheel of his car on his wedding day, an administrative judge became the first official with any authority to say someone involved in the deadly shooting had done something wrong.

Detective Gescard Isnora, who blew his cover to confront Bell and his buddies outside a Jamaica strip club, had already been acquitted of any criminal charges for his role in sparking the melee in which four officers shot 50 bullets at a car carrying three unarmed men in the middle of the night.

The ruling from Judge Martin Karopkin clears the way for Police Commissioner Ray Kelly to fire Isnora, who has been on restricted duty since the shooting.

The cop had testified that he followed Bell and his friends from a Jamaica strip joint, Kalua Club, because he thought Bell’s pal Joseph Guzman was going to retrieve a gun.

Isnora said he opened fire after he was clipped by Bell’s car and saw Guzman’s arm go up. Isnora testified that he never actually saw a gun.

Isnora was found guilty of firing outside the guidelines and coming out of his undercover role, according to Tuesday night’s verdict.

A department spokesman, Paul Browne, said a decision on Isnora’s future had not been made.

The ruling brought a small measure of relief to Bell’s family, who commemorated the fifth-year anniversary of his Nov. 25 death with a candlelight vigil last week on the stretch of Liverpool Street where Bell died, a block that has been renamed in his honor.

“Thank you, Jesus,” Nicole Paultre-Bell, the victim’s fiancée and mother of his two daughters, tweeted yesterday after news of the judge’s ruling spread.

“It’s a relief that one of them could lose their jobs,” Bell’s father, William, said. “But to me, it’s not a punishment. I lost my son. There’s no justice. There’s no way around that.”

The Rev. Al Sharpton, a family adviser, said the ruling vindicates Bell’s supporters.

“It also mandates that the police commissioner immediately fires Detective Isnora and not give retirement benefits to the others who were involved,” Sharpton said in a statement.

Isnora’s lawyer, Philip Karasyk, declined to comment.

Officer Michael Carey, who testified that he opened fire after he heard Isnora yell “Gun,” was acquitted of all charges, officials said.

Detective Endowment Association president Michael Paladino said he was disappointed with the Isnora ruling.

“I disagree with the trial commissioner’s verdict,” Paladino said.

When will police find Karen Johnson Swift?
The body of Karen Swift was found just two miles from her Tennessee home, nearly six weeks after the 44-year-old mother was reported missing.

Tennessee Bureau of Investigation Special Agent in Charge John Mehr told CNN that the body was discovered Saturday in Dyer County, near Bledsoe Cemetery.

Swift was last seen at 1:30 a.m. on Oct. 30.

Later that day, her 2004 Nissan Murano was found abandoned on the Millsfield Highway, roughly half a mile from her home, 77 miles northeast of Memphis.

Swift, a mother with four children, had filed for divorce on Oct. 11, citing irreconcilable differences. However, she and her husband, David, were still living together.

TEXAS CITY — Authorities on Friday released detailed descriptions of suspects wanted in the killings of a man and his daughter during a home invasion.

Texas City Police Chief Robert Burby also announced a $2,000 reward for information leading to an arrest in the fatal shootings of Jorge Luis Vargas, 33, and his daughter Miranda, 15, on Nov. 21.

The two were killed when two men entered their residence in the 700 block of Amburn Road.

Police said one intruder was a black man who wore a covering over his face. He was in his middle to late 20s, stood 6 feet tall and had a skinny build. He wore a black, zip-up cloth jacket and blue or black regular denim jeans, Burby said.

Burby described the other intruder as a Hispanic man with a chubby build and who stood 5-feet, 5-inches tall. The second intruder had a covering over his face, some facial hair, a light mustache and a deep voice. The man wore the same type of jacket as the taller intruder and also wore white or tan Dickies pants and black shoes.

Vargas’ son, 11, was home but was unharmed.

The Mainland Crime Stoppers’ board met Thursday night and authorized up to a $2,000 cash reward for information leading to the suspects’ arrest in the double homicide, Burby said.

Passenger’s quick action leads to child porn arrest

A fast-acting businessman credited with snaring the Utah professor who is accused of viewing child porn on a flight to Boston told the Herald he was stunned by what he saw on his fellow passenger’s laptop screen.

“I’m a pretty big, tough guy, but I cried when I saw it,” said Kurt Wade, a 6-foot-3-inch father of four. “It was the most horrific thing I’ve ever seen.”
Grant Smith pleaded not guilty yesterday in East Boston District Court to possession of child pornography. He was held on $75,000 cash bail pending a Dec. 27 hearing, and barred from having unsupervised contact with children under 16 and from using a computer, except for business, should he post bail.

Wade was seated in first class on Delta Flight 270 from Salt Lake City on Saturday when he spotted Smith in the row in front of him viewing disturbing images, according to a police report. The Arizona software company employee alerted a flight attendant, who also saw Smith looking at child porn, said Assistant District Attorney Erik Bennett.

Wade said he took a photo with his cellphone and emailed his son, telling him to call police in Boston. His son relayed questions from police, who asked Wade to point out Smith when the plane landed.

At Logan, troopers asked to see Smith’s laptop, and he consented, saying it had been bought with a research grant through the University of Utah, where he is a professor of engineering, Bennett said.

On it, troopers found dozens of images of children as young as 5 in a state of nudity or engaged in sex acts with men, he said. At least one is crying while performing a sex act.

When asked if there were any illegal images on his computer, Smith, a divorced father of an 8- and a 10-year-old, debated the definition of child pornography and told troopers he had traded pornographic images of “teens” on the Internet, police said.

The 47-year-old professor told police that after being confronted by the flight attendant, he had erased files from his computer because he was “bored,” Bennett said.

Smith’s lawyer, Patrick Murphy, said Smith has made a “powerful and eloquent denial of the charges.” The University of Utah has placed Grant on administrative leave pending the outcome of the case.

Attorney says suit planned in FAMU band death
ORLANDO, Fla. (AP) - The family of a Florida A&M University drum major who died in what authorities suspect was a hazing incident will sue the school, an attorney said Friday.

The family of Robert Champion, 26, is spending the holiday weekend planning Champion's funeral, attorney Christopher Chestnut said.

The Atlanta resident was found on a bus parked outside an Orlando hotel Saturday night after the school's football team lost to rival Bethune-Cookman. Police said Champion had been vomiting and complained he couldn't breathe shortly before he collapsed.

The cause of Champion's death hasn't been determined. Preliminary autopsy results were inconclusive and a spokeswoman with the Orange County medical examiner's office said it could take up to three months to learn exactly what killed him.

Law enforcement officials have said they believe some form of hazing took place before 911 was called. Chestnut said he also believes the injuries Champion sustained were consistent with hazing.

A spokesman for the school, which was closed for the Thanksgiving holiday, could not be immediately reached for comment Friday morning.

In Florida, any death involving hazing is a third-degree felony.

The fallout from Champion's death was immediate. On Tuesday, the school shuttered the famed marching band and the rest of the music department's performances. The next day, longtime band director Julian White was fired. And Florida Gov. Rick Scott said state investigators would join the probe and the college announced an independent review led by a former state attorney general.

Chestnut said Champion's distraught family believes the actions are "too little, too late."

Champion, a clarinet player, had recently been named drum major.

"He had worked all of his life to reach that goal and it ultimately cost him his life," Chestnut said.

The attorney said Champion's family hopes a lawsuit against the school will help raise awareness about the issue of band hazing.

"This is not an isolated incident," Chestnut said.

Hazing cases have cropped up in marching bands, especially at historically black colleges where a spot in the marching band is coveted. In many cases the bands are revered almost as much as the sports teams for which they play.

In 2008, two first-year French horn players in Southern University's marching band were hospitalized after a beating. In 2009, 20 members of Jackson State University's band were suspended over hazing accusations.

There have been numerous incidents at FAMU. In 2001, Marcus Parker suffered kidney damage after being beaten by a paddle.

Three years earlier, Ivery Luckey, a clarinet player from Ocala, Fla., said he was padded about 300 times, sending him to the hospital. He said he was emotionally and physically scarred. Some 20 band members were suspended and Luckey filed a lawsuit against the state Board of Regents. Reports indicate he settled for $50,000.

A $50,000 reward is being offered for information that leads to the safe return of a missing Orlando woman.


Michelle Parker went missing Nov. 17 after she appeared on a taped episode of "The People's Court" with her ex-fiance.

Her mother announced Friday the reward was from a private donor.

Parker's SUV was found the day after she went missing. Her family thinks the 33-year-old mother of three was carjacked shortly after her appearance on the show.

The Orlando Police Department has not named any suspects.

ROSEVILLE (CBS13) — A local man says the latest movie in the popular ‘Twilight’ franchise triggered a seizure, and similar incidents have been reported in theaters around the country.

Brandon Gephart and Kelly Bauman said they were watching “Breaking Dawn: Part One” at a theater Friday night when Brandon sudden began convulsing during a graphic birthing scene.

Brandon said he doesn’t remember anything until he woke up on the theater floor, but Kelly said he was, “convulsing, snorting, trying to breathe.”

“He scared me big time,” she added. Paramedics transported the man to the emergency room and the theater had to cancel the rest of the movie for that showing.

Several reports on internet movie sites show reports of other people suffering similar symptoms during the same scene, which contains flashes of red, black and white. Dr. Michael G. Chez, the medical director of pediatric neurology and epilepsy for Sutter Sacramento, said the reports indicate the scene may be triggering an episode of photosensitive epilepsy.



While rare, the condition can be triggered by flashing red lights in people who are genetically predisposed.

“It’s like a light switch going off, because it hits your brain all at once,” Dr. Chez said.

Similar reports resulted after a 1990s episode of the television show Pokémon, which triggered seizures in children. Manufacturers have revamped modern television and video games so screens don’t project the dangerous light frequency, Dr. Chez said.

“The trouble with theaters, it’s dark, the lights flashing in there is more like a strobe light,” he added.

A single seizure should not cause long-term damage to most patients, Dr. Chez said. Wearing sunglasses with cheap blue lenses can filter the red light for moviegoers who want to be on the safe side.

Brandon is being checked out by a specialist. Kelly said Brandon has fulfilled his duty as a boyfriend and won’t need to see any more “Twilight” movies with her.

Prosecutors seek 4-year sentence for Jackson doc

LOS ANGELES (AP) — Prosecutors who depicted Michael Jackson's doctor as remorseless for the superstar's death urged a judge Wednesday to sentence him to four years in prison, while a defense lawyer said Dr. Conrad Murray is in a prison of self-punishment and should receive probation.

The opposing sentencing memos were filed in advance of Dr. Conrad Murray's sentencing hearing Tuesday. He has been in jail since he was convicted Nov. 7 of involuntary manslaughter for Jackson's fatal overdose of the anesthetic propofol.

Prosecutors David Walgren and Deborah Brazil wrote that Murray has shown no remorse for Jackson's death and has placed blame on others, including Jackson himself. They cited a series of post-trial media interviews with Murray that they submitted to Superior Court Judge Michael Pastor on a DVD.

In one excerpt, Murray states, "I don't feel guilty because I did not do anything wrong."

"Finally, the defendant consistently blames the victim for his own death," said the prosecution brief, "even going so far as to characterize himself as being 'entrapped' by the victim and as someone who suffered a 'betrayal' at the hands of the victim."

Defense attorney Nareg Gourjian, citing letters of praise from Murray's former patients, said: "There is no question that the death of his patient, Mr. Jackson, was unintentional and an enormous tragedy for everyone affected. Dr. Murray has been described as a changed, grief-stricken man, who walks around under a pall of sadness since the loss of his patient, Mr. Jackson."

Gourjian said Murray will never stop punishing himself over Jackson's loss and, "In effect, he will be serving a form of life sentence. However, the offense was not willful nor intended. ... He is, by every account, immensely sorrowful and remorseful."

Murray was convicted after six weeks of testimony focusing on Murray's administration of the drug propofol, an anesthetic not intended for treatment of insomnia or for home use. While Jackson was under the influence of the drug, Murray admitted leaving the room, prosecutors noted. They said he abandoned his patient when he was the most vulnerable.

In their memo, prosecutors said Murray "acted as an employee and as a drug dealer and completely corrupted the trust necessary in a proper doctor-patient relationship."

Gourjian asked the judge to consider Murray's humble beginnings in Trinidad and his lengthy career of doing good during his practice in Houston.

"The transgression for which he is to be judged should be viewed within the context of the larger life of which it is a part," he said.

He also argued in his 45-page memo that current budgetary problems and overcrowding of prisons has made it necessary to release non-violent, non-dangerous offenders. "Dr. Murray is clearly such a defendant," he said.

Gourjian noted that because of constant death threats, Murray must be kept in solitary confinement, which is expensive.

"Conrad Murray still has the knowledge, capacity and motivation to be a source of healing in the world," Gourjian wrote. "Though he will perhaps not again be a doctor ... he could educate and counsel patients about heart care and disease prevention." He suggested that as a form of community service by the doctor.

Prosecutors attached to their motion a statement of monetary losses because of Jackson's death exceeding $100 million. They suggested that "appropriate restitution" from Murray be ordered for Jackson's children.

Yeater, 20, an unemployed single mom living in San Diego, filed a paternity lawsuit against Bieber on Halloween, but quietly withdrew it two weeks ago as she started receiving death threats, her Chicago-based lawyer, Jeffery Leving, told the Daily News.

Leving said he was trying to have a DNA test done on a confidential basis, but it was not clear whether the lawyer had any say in Bieber’s choice of lab.

“I originally wanted a judge to order a DNA test to make sure the test's chain of custody was safeguarded,” Leving said last week.

“But the reality is that that was before these death threats escalated. And they've gotten so out of control, maintaining strict confidentiality is something we have to try.”

He reserved the right to re-file the case if the two sides can’t broker a mutually acceptable test.

“Arrangements were made for Justin to take the test,” a Bieber source told The News, declining to comment about possible talks with Yeater’s legal team.

Bieber’s lawyer, Howard Weitzman, told TMZ that incriminating text messages purportedly sent by Yeater to a friend help prove she made up the baby-daddy story to get a payday.

The texts, obtained by TMZ, indicate that Yeater thought another man was the father of her baby immediately after the child was born.

“Pleeease ERASE ALL MESSAGES from my mom where she says (the baby) is Robbies Son. Ill kick u when we get paid i'm trusting you pleeease," read one recent text.

An Aug. 16 text to the same friend also identified “Robbie” as the father, TMZ also reported.

“Would you please stress to Robbie how important it is for him to be in his son’s life?” the text read, according to TMZ.

“As we've said from the beginning, it's sad that someone would fabricate such a malicious, defamatory and demonstrably false claim,” Bieber's spokesman, Matthew Hiltzik, said in a statement to The News.

“We'll continue to consider all of our options to protect Justin.”

Bieber didn't seem to be worried about the outcome of his paternity test as he glammed it up at the American Music Awards in Los Angeles Sunday night.

“I originally wanted a judge to order a DNA test to make sure the test's chain of custody was safeguarded,” Leving said last week.

“But the reality is that that was before these death threats escalated. And they've gotten so out of control, maintaining strict confidentiality is something we have to try.”

He reserved the right to re-file the case if the two sides can’t broker a mutually acceptable test.

“Arrangements were made for Justin to take the test,” a Bieber source told The News, declining to comment about possible talks with Yeater’s legal team.

Bieber’s lawyer, Howard Weitzman, told TMZ that incriminating text messages purportedly sent by Yeater to a friend help prove she made up the baby-daddy story to get a payday.

The texts, obtained by TMZ, indicate that Yeater thought another man was the father of her baby immediately after the child was born.

“Pleeease ERASE ALL MESSAGES from my mom where she says (the baby) is Robbies Son. Ill kick u when we get paid i'm trusting you pleeease," read one recent text.

An Aug. 16 text to the same friend also identified “Robbie” as the father, TMZ also reported.

“Would you please stress to Robbie how important it is for him to be in his son’s life?” the text read, according to TMZ.

“As we've said from the beginning, it's sad that someone would fabricate such a malicious, defamatory and demonstrably false claim,” Bieber's spokesman, Matthew Hiltzik, said in a statement to The News.

“We'll continue to consider all of our options to protect Justin.”

Bieber didn't seem to be worried about the outcome of his paternity test as he glammed it up at the American Music Awards in Los Angeles Sunday night.

He strutted along the red carpet, with his hair slicked-back and wearing a velvet tuxedo, and stopped to peck girlfriend Selena Gomez on the cheek.

Frivolous and selfish is how lawyers for Amazon.com describe a lawsuit brought by an actress upset that her advanced age – 40 – was revealed on an Internet database.

The company, along with its Internet Movie Database, asked a federal judge last week to dismiss the million-dollar complaint brought by the woman, who identified herself only as Jane Doe, a Texas resident of Asian descent.

The woman claimed that soon after she signed up for a subscription service called IMDb Pro, her birthdate appeared on her profile on the database – and her offers for roles dropped sharply. She alleged that Amazon and IMDb had used her credit card information to glean her birthdate, which she had always tried to keep a secret because she looks so much younger than she is.

The case prompted discussions about ageism in Hollywood – as well as rampant online speculation about who the actress might be. But in its two motions to dismiss the case, Amazon and IMDb argued that it’s about something else: “the perpetration of fraud.”

“Plaintiff’s attempt to manipulate the federal court system so she can censor IMDb.com’s display of her birthdate and pretend to the world that she is not 40 years old is selfish, contrary to the public interest and a frivolous abuse of this court’s resources,” they wrote.

Her failure to identify herself in the complaint without first seeking the court’s permission violated court rules, they said, and although they believe they know who she is, they’re not entirely sure. Furthermore, they argued, when customers subscribe to IMDb Pro, they agree to a privacy policy which makes clear that the database can keep and use certain personal information.

“Even if IMDb.com used plaintiff’s name, address or zip code from her credit card subscription to locate her birthdate, such use is consistent with the subscriber agreement and privacy policy,” they wrote.

The actress claimed that she had always been careful about keeping her given name and birthdate confidential. As an unknown, she used an Americanized stage name in 2003 when she first listed herself on imdb.com, a listing which she said brought her several jobs, and her real name was not publicly known, she said.

“If one is perceived to be ‘over-the-hill,’ i.e., approaching 40, it is nearly impossible for an up-and-coming actress, such as the plaintiff, to get work as she is thought to have less of an ‘upside,’” her claim said.

She argued that she never consented to having the personal information she provided used for anything but the commercial transaction. IMDb refused to remove the reference to the woman’s age from her profile when asked, the lawsuit said.

IMDb agreed that it had refused to remove her birthdate – and noted in asking the judge to dismiss the case that the actress had also requested that the company falsify her age on the website.

The actress is seeking $1 million or more in punitive damages as well as $75,000 or more in compensatory damages. She accuses Amazon and IMDb of breach of contract, fraud and violation of privacy and consumer protection laws.

A Lauderhill Police officer is heard repeatedly screaming for help after a fellow officer allegedly opened fire on her in the radio calls of the incident released Thursday night.

Officer Brittny Skinner was working an off-duty security job at a shopping plaza in the 5500 block of West Oakland Park Boulevard Saturday night when the shots rang out.

"Um, I think somebody just shot at a cop over here," a caller is heard telling a 911 operator in one of the audio recordings released Thursday. "I'm at 56 and Oakland and we just heard like 5 or 4 gunshots at a police car, I believe."

What the caller heard was the 10 rounds which police say were fired by fellow Lauderhill cop and Skinner's ex-boyfriend, Kristopher Bieger, who unloaded his Glock pistol into Skinner's patrol car.

"Oh my God!" Skinner is heard screaming, as she calls the shooting into police dispatch moments after the shooting. "Have units respond over here, please please please!...I'm at 55 Oakland. Please help me!"
Only one of the shots struck Skinner, but her bullet-proof vest kept it from tearing through her.

"Oh god, oh god help me please! Please help me right now! Please God help me right now!" Skinner repeats.

With Skinner's police department up the street from the shopping center, less than a mile away, she decides to drive there.

"I'm driving to the P.D. now," Skinner says, before briefly losing her cool. "Just f---ing get to the f---ing station!"

As the dispatch works to get officers to the scene, Skinner continues to plead for help.

"Shots fired into my vehicle, please help me," she says.

Bieger was later found at a pizzeria in Davie, where a SWAT team swarmed in and took him into custody.

He was in court Monday, where he pleaded not guilty to charges of attempted first-degree murder and discharging a firearm from a vehicle.

Court documents said Bieger and Skinner had started dating two to three months ago but she broke up with him over the phone last week, because of his "controlling behavior" and "severe mood swings."

He did not take the rejection well and "began to cry uncontrollably," and "begged for her to not break up with him," according to the court documents.

Bieger, who has been on the force since 2006, has been suspended without pay.

The conclusions of an autopsy of rapper Heavy D have been deferred pending the results of toxicology tests, the L.A. County coroner's office said on Monday.

Officials said the autopsy was inconclusive and that it could take several weeks to determine a cause of death.

Ed Winter, a coroner's spokesman, said last week no illegal drugs were found at Heavy D's Beverly Hills home, but a doctor had prescribed him a drug after the rapper, 44, experienced a cough.

Heavy D experienced breathing problems at his condo complex on Maple Drive and then collapsed.

TV characters don't get much cooler than Arthur Herbert Fonzarelli, better known as "The Fonz" on the long-running ABC sitcom "Happy Days" that aired Tuesday nights from 1974-84. At its ratings high point the show was watched by some 40 million Americans, who tuned in to see the adventures of 1950s Milwaukee high-schooler Richie Cunningham (Ron Howard), his family and friends. Originally a bit player, Fonzie as portrayed by Henry Winkler become the show's big breakout star. So iconic was the loveable biker and ladies man that TV Guide named him as number 4 on its "50 Greatest TV Characters of All Time" rankings. When the show was finally cancelled, his trademark brown leather bomber jacket was acquired by the Smithsonian Institution.

But what of The Fonz's other prop, his Triumph motorcycle? As often happens with vehicles used in television and movies, once production shut down it seems to have wandered off, lost to the mists of time. So it was with the "Happy Days" Triumph, until Cycle World writer Wendy F. Black was assigned to track it down for a story in 2000. Her quest started with the kingpin of all things having to do with Hollywood and motorcycles: Bud Ekins, racer, stuntman, provider of car and bikes to the studios.

According to Ekins, there were actually three Triumphs, all 500cc Trophy models of various years, used on the show, two of which had indeed gone missing – stolen, raced into the ground or sold off for parts. But Ekins not only knew about the third and remaining Triumph, he had originally supplied it to Paramount Studios after yanking off the front fender, bolting on a set of buckhorn handlebars and painting the gas tank silver. The Fonz, after all, would not ride a stock motorcycle. Ekins also pointed the magazine writer north to Oakland where the sole remaining Fonzie bike had been since 1990, hiding in plain sight, stored unceremoniously at Mean Marshall's Motorcycles. Shop owner Marshall Ehlers purchased the bike from Ekins not for its star power but for the model's race history, its all-alloy engine and its sparse good looks. At one point he even considered restoring the Trophy back to showroom-stock spec.

Happily that didn't happen and now one of the world's coolest Triumphs, untouched since it last rolled across television screens 27 years ago, is ready for its second act. A portion of proceeds from the sale will be donated by Bonhams to aid Henry Winkler's charitable work in support of children with dyslexia.

What will former Pennsylvania State Senator Vincent Fumo's new sentence be?
Vincent J. Fumo, the once-powerful, now-disgraced state legislator, was resentenced today in an extraordinary hearing to 61 months, six more than his previous sentence.

Mr. Fumo, 68, at one time the most influential legislator in Pennsylvania, was convicted in 2009 of misusing million in state funds. Though eligible for a sentence of at least 17 years, Mr. Fumo was given 55 months by U.S. District Judge Ronald L. Buckwalter, who handled the latest proceeding.

Before delivering the new sentence, Judge Buckwalter reviewed e-mail that Fumo had sent from prison and declared that Mr. Fumo lacked a "true sense of remorse" and a "complete lack of respect for our legal framework."

Mr. Fumo listened, but showed no emotion. He was led away in handcuffs shortly afterward.

After Mr. Fumo is released, Buckwalter ruled, he must perform community service of 10 hours a week for three years.

The judge had come under intense public criticism for the 55-month sentence. In August, Judge Buckwalter convened the hearing after an appellate court ordered him to reconsider Mr. Fumo's sentence based on a new calculation of the dollar value of Fumo's crimes.

But Judge Buckwalter said the the federal sentencing guidelines, which called for 17 to 22 years in prison, were "completely unfitting" to the crimes.

He noted that a corrupt former Philadelphia treasurer got 10 years in prison, and former City Councilman Rick Mariano got 7 1/2 years.

"None of these cases are comparable" to Mr. Fumo's, the judge said. He said both the treasurer and Mr. Mariano faced extortion charges.

The judge cited the corruption case against New Jersey State Sen. Wayne Bryant, who was sentenced to four years. And he said that former Philadelphia State Sen. Buddy Ciafrani - who placed ghost employees on the payroll - served only 27 months for those crimes.

Judge Buckwalter said despite letters demanding a lengthier sentence, he would not respond to "public outrage."

Though the offenses required prison time, the guideline range of 17 years should be for people who sell their office for personal gain, the judge said.

If he had given Mr. Fumo 15 years, as the government requested, it would be a death sentence for Mr. Fumo, Judge Buckwalter said.

As to future crimes, the judge said Mr. Fumo lacks the power he once had, and based on his health, his age and what Fumo said in court today, "I do not believe he will pose a threat to society" upon release.

Since the 2009 sentencing, Mr. Fumo has been jailed at a federal prison in Ashland, Ky.

Judge Buckwalter noted that the Mr. Fumo's crimes were not violent, but called the former state senator's schemes "arrogant."

From Mr. Fumo's crimes, the judge said, the government brought more than 100 counts of offenses. Federal guidelines warn against overcharging, and in Fumo's case the government brought far too many counts, the judge said.

Judge Buckwalter said the number of charges reflected "the very unfairness" that the manual counsels against. The judge says many people who wrote him emphasized the sheer number of counts.

Judge Buckwalter also said that Fumo's offenses were "indeed serious," and "not to be condoned." Yet he emphasized that Fumo was not involved bribery or extortion.

Mr. Fumo was a state senator for 30 years, the judge noted. But the federal case against him was not a political prosecution.

Judge Buckwalter said the taxpayers were the victims, but added that Mr. Fumo has paid considerable restitution. Mr. Fumo has already paid about $2.5 million in restitution and fines, The govrenment has argues that he owes another $1.5 million.

Moreover, the judge said the Fumo case was a "cautionary tale" for voters, too. He said they could have used the voting booth to check the politician.

He said that the government claimed Mr. Fumo merely did his job in the Senate. But Judge Buckwalter, in a monotone with little or no dramatic emphasis, said Fumo went beyond that. In his 30 years as a Senate, Fumo had a lengthy record of accomplishments, a presentence report by court officials found, the judge said.

Mr. Fumo helped create hospitals for the poor, saved the Civil War Library, and helped the Food Distrbution Center, Judge Buckwalter said. Plus, the judge said he got 250 letters from people who said he had done many good works.

Though Mr. Fumo's charitable acts "neither justify nor excuse his crimes," they did justify a variance from the guidelines, Buckwalter said.

MILWAUKEE -- There's more sad news for the family of a woman hit and killed on Milwaukee's south side Sunday night.

WISN 12 News spoke to the daughter of Frances Pizzaro on Wednesday morning.

Pizzaro and her son were walking near 14th Street and Greenfield Avenue on Sunday night when an accused drunken driver hit them.

Her family told 12 News that her son is in extremely critical condition, and the prognosis is not good.

The 41-year-old man who caused the crash has not officially been charged, but the district attorney is reviewing the case.

Investigators said he was driving at speeds up to 100 miles per hour just before the crash.

The suspect did not have a valid driver's license and has three prior convictions for drunken driving.

First Degree Murder: Murder with malice aforethought. This classically requires Mens rea and Actus Reas -- evil intent and evil act. So 1st degree would include:
