Jurors in Montgomery County on Wednesday will consider the penalty for 30-year-old Conroe police Sgt. Jason Blackwelder. He faces from probation up to 20 years in prison.

The officer was convicted Tuesday in last July's fatal shooting of 19-year-old Russell Rios.

CONROE, Texas - Conroe Police Officer Jason Blackwelder has been indicted on one count of manslaughter for the fatal shooting of a teen outside a Walmart in late July, the Montgomery Coutny District Attorney’s Office announced Friday.

The district attorney’s office said a grand jury also returned indictments of tampering with a government document and one count of false report to a police officer.

Blackwelder is accused of following 19-year-old Russell Rios from a Walmart where he was accused of shoplifting. The officer said, once in a wooded area, the teen choked him. Blackwelder opened fire and killed Rios.

Both the defense and prosecution rested their cases Friday in the manslaughter trial against Conroe PD Sgt. Jason Blackwelder.

Twelve jurors now will begin deliberation on a verdict following closing arguments when court resumes Monday.

The defense brought two expert witnesses Friday to create doubt in the prosecution’s charge that Blackwelder acted recklessly in killing 19-year-old Russell Rios last summer after Rios was caught shoplifting at the North Loop 336 Walmart in Conroe.

Blackwelder, off-duty and leaving Walmart with his wife on July 31, 2013, noticed loss prevention employees pursuing Rios before joining the pursuit and chasing him into a wooded area.
